does a waiver actually cover you in the event an injury occurs to anarmwrestler at an event?? any help is greatly appreciated since this is the only road block I have right now preventing me from running a tourney locally.

Hi Mike, If you do not used trained/skilled referees the release is worthless. The release form will release you (and the location etc.) from everything but negligence. Using untrained officials is negligence. No waiver will ever release you from negligence. I do know that you are trying to get trained officials and that you do care about the athletes and your sponsors. Hopefully you can find someone nearby to help you out. Denise

thanks denise for the insight. I will have Kevin Bender doing the ref duties and I think you had him help you guys out at the TOC in bettendorf Iowa recently. The owner is letting us have training sessions for education purposes to teach guys proper techniques and this will be every other saturday for a few months until we get enough interest to have a iowa state championships. The sessions will be VERY strict with no actual hard pulls just slow technique building moves and form.

Hummm , I can answer that real easy <NO>...I don't care what kind of referees you have in place, I'm going through litigation as we speak, I been to court three times and a trial date is set for November...I'm getting sued as the promoter, Mike McGraw is getting sued for breaking the arm and my host site is getting sued for having the event.... Now with that being said, a solid wave is going to help you out considerably and as Denise mentioned qualified staff... We'll most likely win the case. Between Mike and I we have out of pocket 6K and that doesn't count the trial and you can't counter sue if their part of that ligation....Should you worry hell yes...should it stop you from putting on an event no... A solid waver, proper signatures, qualified staff with understanding rule is a plus... I suggest to any promoter please have some wording in their waver such as: IN THE EVENT OF LIGATION or LAW SUIT the defendants, (promoter, staff, participants, host site, yada yada yada) will be compensated all attorney fees that encountered in such claim...of course this is a short version My waiver went from a simple 1/2 page to a complex two page...

Save yourself the headache and only have open or pro classes. You won't make a lot of money like you would offering everything but you get more sleep.

I was lucky back in 2002. We had an arm break, the person tried to sue, but only went after the place we held it. Waivers or not, there is always that possiblity. I also remember back in the 90's, we used to have a Pull For Kids @ the Meriden Elks Lodge, & all the money raised went to the Newington Childrens Hosp. There was an arm break & it just so happen to be a woman. She went & sued everyone involved. It was a great loss for all parties involved, & we were never able to hold another event for that Charity!! Sometimes people really suck. Armwrestling is a contact sport, & sometimes people can get hurt. Do the best you can & try to cover all the bases. Qualified refs go a long way. Even if you have to pay for them, whats $50.00- $100.00 a ref? Unless you have great sponsors & can pay them more... ;D Best of Luck in putting together your first event Mike.

I was at that event that Bill and Mike are being sued over. If I remember correctly, it was an amateur person who had never armwrestled before entering a pro competition. The guy broke his own arm at the go! Mike didn't even move, the guy just jumped straight into an arm break position and snap! I think that a person should have to place in the top 3 in at least one or two amateur events before moving up to the pro/open class.

Hey Kelli Great seeing you back in action and on the board and your correct about the knuckle head who broke his own arm.. he actually entered the Am class and then moved himself into the open class to try and win some $$$$$...As you know the host site does the weight-ins & sign ups at this event...He also happen to be a law student, needless to say he has to spend a little of his own money because he didn't do well representing his case... As of today I will let any person enter an open class if they chose, but you can bet that there will be a statement in my waver that will allow all involved counter sue in the event of ligation...
